When you say rust, to what degree is the rust. I have rust at the tank base but judging from the degree of rust mine is safe to use. If st juz surface rust it's fine. Rust removal followed by a paint job will solve the problem. If it rusted till it's leaving a 'crater' or a hole on the surface, it's not recommended to use it at home nor anywhere else.
If you're still unsure, get it tested by SOXAL. Once tested, they will mark it safe by international standards.

Surface rust with shallow craters. Very shallow only, I just briefly remove the rust and cover with musking tape. No time to paint.
